Specialist Property Services
Hubbard Pegman & Whitney LLP's Specialist Property Services Department is able to offer a full range of Landlord & Tenant service for both residential and commercial properties. We pride ourselves on being able to offer timely advice and assistance taking account of the realities of the ever changing property market. To that end, we regularly receive referrals from a wide range of professionals including surveyors, estate agents, accountants and other property professionals.
The department has substantial experience in the following areas:-
- Residential Landlord & Tenant matters including seeking possession of properties both on mandatory and discretionary grounds;
- Dilapidation claims in respect of commercial Leases including matters in connection with Section 18 Defences;
- Contested Rent Reviews including arbitration and expert determination;
- Collective Enfranchisement and Lease Extension claims both for freeholders and leaseholders including representing clients at the Leasehold Valuation Tribunal and the Lands Tribunal;
- Residential service charge disputes including representation at the Leasehold Valuation Tribunal;
- Variation of residential Leases by way of application to the Leasehold Valuation Tribunal.
David Whitney the Partner in charge of the department is a member of the Association of Leasehold Enfranchisement Practitioners (www.alep.org.uk) and has over 12 years of experience in advising on all aspects of property litigation from large portfolio investors through to individuals. It is our aim to provide a seamless service covering a full range of property services and liaising closely with our commercial and residential conveyancing department, all of which are based under one roof and aim to provide a holistic service for clients. In particular, our team give emphasis to the commercial realities of the situation including always offering to give full advice both as to timescales and costs of any action.
