The Court of Appeal has recently declared that General Damages (otherwise known as ‘Pain Suffering and Loss of Amenity’) will be increased by 10% from 1 April 2013. This is something which should be seen as a bonus for Claimants who have historically in this Country seen very low awards for General damages.
However, the interplay with this and the Jackson reforms mean that the question of recoverability of Success Fees may negate any benefits in respect of this. Legal Practices are trying to come to terms with what they should do about recoverability of Success Fees and the announcement made by the Court of Appeal in Simmons v Castle (2012).
