The HMCTS have launched an online divorce system as a way of bringing the divorce procedure into the modern age. The aim is to allow the public to have a more easily accessible and cheap route to the justice system.
Online divorce may be an easier option if the parties were to receive independent legal advice regarding their position. It is possible for the parties to commence financial proceedings if an agreement is not reached prior to finalising the divorce. Financial claims can be brought many years after the divorce if an agreement had not been reached, signed and approved by the court who will dismiss all future claims in respect of the marriage and any future inheritance.
It also must be noted that you may lose the right to a financial claim if the right box in the petition had not been ticked in the divorce procedure or you re-marry.
As mentioned previously, on some grounds of divorce, the spouse would need to consent. Failure to consent could make the divorce procedure more difficult.
