Survivors of domestic violence are in need of a lawyer they can trust whilst they battle with this difficult period, not just after.

At Hubbard Pegman & Whitney, our team of domestic abuse solicitors support and empower survivors of domestic violence, helping them to get the safety and justice that they deserve.

If you are unsure whether you have been a victim of domestic violence, we can help you identify the signs of abusive relationships. The definition of domestic violence is:

‘Any incident or pattern of incidents of controlling, coercive, threatening behaviour, violence or abuse between those aged 16 or over who are, or have been, intimate partners or family members regardless of gender or sexuality. The abuse can encompass, but is not limited to psychological, physical, sexual, financial, emotional.’

If you feel like you have been a victim of domestic violence and require urgent help, our team of expert family lawyers can seek the proper urgent protection you need. Contact Susanna Russell or Primrose Hudson today to start your journey discretely.

Please note, some who have experienced domestic violence may be entitled to legal aid. This is the provision of legal representation for those unable to afford it. While we do not offer legal aid, please do speak to us to find out if you are eligible.

Types of protection available

A Non-Molestation Order:

This is a protective injunction that can be obtained urgently and without giving notice to the perpetrator. This order is available if you and/or your children are suffering from domestic violence or threatened violence and harassment.

Once this Order is granted by the Court, any attempted breach by the perpetrator will be subject to an order for arrest.

An Occupation Order:

This Order will seek to protect you from a perpetrator you live with. If you are granted this Order, the perpetrator will be banned from entering your home.

Injunctive Orders hold a lot of power to protect the victim of domestic violence and require technical evidence to be presented to the Court to obtain them.

Our expert lawyers have decades of experience assisting victims of domestic violence and securing injunctive orders for the victims in need. We understand how difficult it is to speak about the abuse you may have gone through, and we approach every matter with the upmost sensitivity and confidentiality.

The court process for obtaining an Injunctive Order can be lengthy, but our family lawyers have the expert knowledge to ensure that matters can be dealt with as swiftly as possible. Your safety is our priority, and our team will do all they can to prepare strong submissions on your behalf to succeed your application for an Injunctive Order.

Defending False Domestic Abuse Allegations

We care deeply about every getting the justice they deserve. Our family lawyers are repeatedly instructed by respondents in injunctive proceedings and are able to offer practical advice during your time of stress.
